- Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON- INFRINGEMENT. 121VIBES DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
- Limitation of Liability
IN NO EVENT SHALL 121VIBES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF 121VIBES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 121VIBES'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO 121VIBES FOR THE USE OF THE PLATFORM IN THE SIX (6) MONTHS PRIOR TO THE DATE THE CLAIM AROSE.
- Indemnification
You agree to indemnify and hold harmless 121vibes and its affiliates, officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and defense costs, arising out of or relating to your use of the Platform, your violation of these Terms of Service, or your violation of any rights of another.
- Service Interruptions
121vibes may experience interruptions in service due to various factors, including but not limited to:
- Maintenance and Upgrades: Planned or unplanned maintenance and upgrades to the Platform may result in temporary service interruptions.
- Technical Issues: Technical issues, such as network outages, server problems, or software bugs, may also cause service disruptions.
- Force Majeure Events: 121vibes shall not be liable for any service interruptions caused by events beyond its reasonable control, such as natural disasters, acts of war, or government regulations.
- Third-Party Services
The Platform may integrate with third-party services, such as voice/video calling platforms or payment processors. 121vibes is not responsible for the actions, policies, or services of any third-party providers.
- Termination
121vibes may terminate your access to the Platform at any time, with or without cause, and with or without prior notice. You may terminate your use of the Platform at any time by ceasing to access it.
- Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms of Service shall be brought exclusively in the courts located in Karkardooma Court, Delhi.
- Entire Agreement
These Terms of Service constitute the entire agreement between you and 121vibes with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, and understandings, whether oral or written.
- Severability
If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
- Waiver
The waiver by 121vibes of any right or provision of these Terms of Service shall not constitute a waiver of such right or provision on any other occasion.

121vibes may revise these Terms of Service from time to time. We will notify you of any material changes by posting the updated terms on the Platform. Your continued use of the Platform following the posting of any changes constitutes acceptance of those changes.
